These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MiningHere JCJ ("MiningHere," "Company," "we," "us," or "our"), a company registered in Turkmenistan with registration number 47293816.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be a resident of any jurisdiction where cryptocurrency mining or trading is prohibited
• Not be subject to any sanctions or restrictions that would prohibit your use of our Services
• Complete our verification process as required by applicable regulations

3. Description of Services

MiningHere provides cloud-based Bitcoin mining services. Users can purchase mining contracts that allocate a portion of our mining hashrate to their account. Key aspects of our Services include:

• Mining Contracts: Users purchase contracts representing hashrate allocation from our mining infrastructure
• Daily Payouts: Mining rewards are calculated and credited to user accounts daily
• Dashboard Access: Real-time monitoring of mining performance and earnings
• Withdrawals: Users may withdraw accumulated earnings to their personal Bitcoin wallets
• Referral Program: Users may earn commissions by referring new users to the platform

4. Account Registration

To access our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities occurring under your account

We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

5. Mining Contracts and Payments

5.1 Contract Terms

Mining contracts are offered for specific durations and hashrate allocations as displayed at the time of purchase. Contract terms, including pricing and duration, are fixed at the time of purchase and cannot be modified afterward.

5.2 Payment

Payments for mining contracts are accepted in cryptocurrencies as specified on our platform. All payments are final and non-refundable once confirmed on the blockchain.

5.3 Mining Rewards

Mining rewards are calculated based on your allocated hashrate, network difficulty, and Bitcoin block rewards. Rewards may vary due to factors beyond our control, including network difficulty adjustments and Bitcoin price fluctuations.

6. Withdrawals

Users may request withdrawals of their available balance at any time, subject to:

• Minimum withdrawal amounts as displayed on the platform
• Verification requirements for security purposes
• Network transaction fees (borne by the user)
• Processing times, typically within 24-48 hours

We reserve the right to delay or refuse withdrawals if we suspect fraudulent activity or Terms violations.

7. Prohibited Activities

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the Services
• Engage in any form of market manipulation or fraudulent activity
• Use automated systems or software to extract data from the Services
• Create multiple accounts for the purpose of abusing promotions or referral programs
• Impersonate any person or entity or misrepresent your affiliation

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by MiningHere and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO OUR SERVICES.

We do not warrant that:

• The Services will meet your specific requirements
• Mining operations will be uninterrupted or error-free
• Any specific level of mining rewards or returns will be achieved
• The Services will be compatible with all hardware and software

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MININGHERE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

Our total liability for any claims arising from your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless MiningHere and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Services after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Turkmenistan. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Ashgabat, Turkmenistan, unless otherwise required by applicable law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
